Now this has got to be one ridiculous lawsuit; a guy starts a fight with someone at a McDonald's drive-through, gets killed, and now the family is suing McDonald's because instead of going out and stopping the fight the manager called the police. Sounds like someone is just trying to make some quick money to me.

Having worked at law firms for a big chunk of my adult life, I can tell you that this will hinge on two things, both of which were mentioned in the article: is there a history of violent behavior at this particular McDonalds, and -- in that context -- how long did the fight go on before the manager called police? If there were frequent fights and violence at this location, and the store did not hire security personnel, they're gonna be liable. I don't think it's right, but that's the way things are going in litigation land these days.
A lot depends on what sort of people get on a jury, also.
